German soldiers were treated as war criminals by the Allies after World War II

I am answering a comment, made by one of the readers of my blog, with a new blog post.

The following quote is from the comment directed at a Jew who had made a comment:

“…you get on the sins of other people; yet you forget the sins of the Jews. For instance, you say nothing about the Sonderkommando [Jews] who supposedly worked in the gas chambers, inviting their own people into those gas chambers. So their sins are forgiven: Jews can kill Jews to save their own lives, but that’s okay.  They were only following orders because they would be killed [if they didn’t].  Right? But its a different story when the German soldiers get hung, after the Nuremberg trials, for following their orders too.”

German soldiers were treated quite differently after they had surrendered in World War II.

The U.S. Third Army and the U.S. Seventh Army remained in Germany after World War II ended on May 8, 1945, and their War Crimes Detachments immediately began arresting suspected German war criminals; 400 to 700 persons were arrested each day until well over 100,000 Germans had been incarcerated by December 1945, according to Harold Marcuse who wrote a book entitled “Legacies of Dachau.”

The former Dachau concentration camp already held 1,000 German soldiers, accused of war crimes, by the end of June 1945. They were put to work cleaning up the barracks.

In July 1945, General Dwight D. Eisenhower became the first military governor of the American Zone of Occupation in Germany. The accused Germans could expect no mercy from Eisenhower who had written in a letter to his wife, Mamie: “God, I hate the Germans.”

The authority for charging the defeated Germans with war crimes came from the London Agreement, signed after the war on August 8, 1945 by the four winning countries: Great Britain, France, the Soviet Union and the USA.

The basis for the charges against the accused German war criminals was Law Order No. 10, issued by the Allied Control Council, the governing body for Germany after World War II ended.

Law Order No. 10 defined Crimes against Peace, War Crimes, and Crimes against Humanity. A fourth crime category was membership in any organization, such as the Nazi party or the SS, that was declared to be criminal by the Allies. The war crimes contained in Law Order No. 10 were new crimes, created specifically for the defeated Germans, not crimes against existing international laws. Any acts committed by the winning Allies which were covered under Law Order No. 10 were not considered war crimes.

The German prisoners at Dachau were not treated as Prisoners of War under the Geneva convention because they had become “war criminals” at the moment that they committed their alleged war crimes. Every member of the elite SS volunteer Army was automatically a war criminal because the SS was designated by the Allies as a criminal organization even before anyone was put on trial. Any member of the Nazi political party, who had any official job within the party, was likewise automatically a war criminal regardless of what they had personally done.

Under the Allied concept of participating in a “common plan” to commit war crimes, it was not necessary for a Nazi or a member of the SS to have committed an atrocity themselves; all were automatically guilty under the concept of co-responsibility for any atrocity that might have occurred.

The only good German was a traitor to his country; the German SS soldiers imprisoned at Dachau had volunteered to fight for their country; therefore they were war criminals and did not deserve to be treated as POWs under the Geneva Convention of 1929.

The basis for the “common plan” theory of guilt was Article II, paragraph 2 of Law Order No. 10 which stated as follows:

2. Any person without regard to nationality or the capacity in which he acted, is deemed to have committed a crime as defined in paragraph 1 of this Article, if he was (a) a principal or (b) was an accessory to the commission of any such crime or ordered or abetted the same or (c) took a consenting part therein or (d) was connected with plans or enterprises involving its commission or (e) was a member of any organization or group connected with the commission of any such crime or (f) with reference to paragraph 1 (a), if he held a high political, civil or military (including General Staff) position in Germany or in one of its Allies, co-belligerents or satellites or held high position in the financial, industrial or economic life of any such country.

Waffen-SS soldiers in the prestigious Liebstandarte-SS Adolf Hitler Division, known as the LAH, were separated from the other Waffen-SS POWs and brought to the War Crimes Enclosure at Dachau where they were interrogated by a special team that was investigating the “Malmedy Massacre.” This resulted in a scandal that was investigated by the U.S. Congress after accusations by the LAH soldiers that they had been tortured at Dachau by the Jewish interrogators to make them confess to crimes which they claimed they didn’t commit.

The Soviet Union set up 10 Special Camps for German soldiers.

The former Buchenwald concentration camp became Special Camp No. 2 while the former Sachsenhausen concentration camp became Special Camp No. 7. Both of these camps were in the Soviet Zone of Occupation, behind the “Iron Curtain” and were run by the Soviet secret service, the NKVD.

The British also set up a number of camps: the former Neuengamme concentration camp near Hamburg became No. 6 Civil Internment Camp and KZ Esterwagen became No. 9 Civil Internment Camp. The British camp at Bad Nenndorf was a particularly brutal place where former German soldiers were tortured between 1945 and 1947.

News commentator Bill O’Reilly commented on the brutality of the Bad Nenndorf camp on his show a couple of years ago.

German soldiers, that were rounded up by the War Crimes Detachment of the U.S. Seventh Army, were put into Civilian Internment Enclosure No. 78 in Ludwigsburg, Germany. In March 1946, the U.S. Seventh Army left Germany and their German prisoners were transferred to Dachau.

  1. Okay I’m confused ( nothing new there). The SS soldiers “volunteered”,to fight for their country,therefore they were “war criminals “. I volunteered to go to ‘Nam. Does that mean I’m a war criminal? We had a shitload of men volunteer for WW2. Does that make them criminals too?

  2. At war end USA felt it nessesary to divert attention from:
    1. In several USA States ruled higher or lower racial discrimination against colourated people.
    2. In some states programms to sterilize persons who were only needy or had been considered – arbitrarly – as mentally ill. Noteworthy that in Germany the persons responsable or involved in the EUTANASIA programm had been put on trial only by the German authorities.
    3. President Rooswelt wanted only to have the support of Jewish voters but did not care at all about the fate of European Jews. And Hitler had been aware of this attitude.
    By the way the same applies to the Shoah Business Tear Pressing Stories Division which arranges lectures of aged Shoah survivors easy to advise “how to speak about events”. So the Negationism Division is enabled to market its “products”. So there is no space in USA for thorough historical studies about WWII, Nazism, Holocaust

  4. Only for history. The SS Totehkopf Verbaende had been in origin an Armed Party Militia. The Concentration Camp guards, the JUDENJAEGER and others belonged to the Totenkopf Verbaende.
    The WAFFEN SS in origin had been set uo to enlist the Ethnic Germans of East Europe who for legal reasons could not enter the Wehrmacht. Then, as I had been told by a German gentleman, 20 per cent of joungsters called to army had to be enlisted to the Waffen SS where the death toll had been very high.

    • Wolf, I thought I’d answer you here about Poland.
      I don’t think we can look at Hitler as the typical German expansionist in regards to Poland. As an Austrian he didn’t have the same types of prejudices as the Prussians did in regards to Poland. I think Hitler was willing to work with the Poles as long as they have him what he wanted. Germany and Poland had very friendly relations after 1933 until the Spring of 1939.
      I think what Hitler wanted with the Poles was an alliance against Russia……on German terms, mainly the reversion of Danzig to German control and specific German rights in the Corridor. Later, if the Poles played ball and did what they were told the Corridor would revert back to Germany, with the Poles compensated with Soviet Territory.
      What stymied Hitler’s efforts in this area was Polish resistance to align with either Germany or the Soviet Union. Polish insistence on remaining neutral doomed any chance of German-Polish cooperation in regards to the Soviet Union. The Poles refused to negotiate over the Corridor and Danzig, backed by British and French guarantees (unfortunately for the Poles, they took these guarantees literally).
      So, while I agree that historically German aims in regards to Poland included the loss of territory and independence, I think you have to look at Hitlers aims and motivations differently.

      • JEFF. We ought to consider – as Hitler did – the Prussians hatred and aims of subduing the Poles. The German romanticism first and the “thinker” Paul de Laguard/Paul Boettiker wrote about conquering Poland and settle there German peasants avoiding their emigration to America. This in the view of a Germany led European Area. Besides, Germany wanted to have the Polish agricoltural soil.

        • Hitler considered the Ukraine far more important for its agricultural than Poland, Wolf. He also considered the Soviet Union a much better candidate for colonization than Poland.
          Historically you are right, Wolf. Germans looking to expand Eastward looked at Poland, wanting to clear out the Poles and encourage Germans to move into those areas. One of the problems they ran into is the Poles do not take kindly to being supplanted and will fight long and hard. Another problem is number of Germans versus the number of Poles, there were always more Poles. Germans tended to emigrate to the United States than to Poland, Hitler wanted to reverse that trend.
          Hitler broke the mold, so to speak. Hitler never wanted oversea colonies (much like Bismark, who considered them a liability). Hitler considered the Soviet Union as a place for colonization and thought it would easy with the Jewish-Bolshevists in charge (his thought, not mine).
          Consider the course of German foreign policy in the 30’s. Hitler sought alliances with the British, hoping to come to an agreement where Germany would dominate Europe and Britain would dominate outside of Europe. Hitler also cultivated the Poles, signing a treaty with them in 1934. Unlike Weimar, Hitler never pressed the issue over the German minority in Poland. Hitler allowed the Poles to take a slice of Czechoslovakia after the German occupation. I posted a link describing Polish-German relations earlier, here:

          Unlike Weimar, Hitler stopped working with the Soviet Union and turned to the Poles.
          Hitler’s initial demands on the Poles were quite moderate, wanting only rights in the Corridor and the return of Danzig to German control. It was only after the Poles spurned him did Hitler turn against them.

          • JEFF. From the diary of Italian Foreign Minister Ciano about his talk with Rippentropp: “What do yoi want? … “We want war with Poland”. The treaty of 1934 had been only a step to gain time. And the Polish Government of former collonels never had read the Mein Kampf and did not understand the real aims of Nazism. In 1937 the Polish rulers started controlls over the Jewish Comunities and other hostile policies. They realized the danger when already too late, in March 1939 after Hitler had occupied entire Tsechoslovakia; Poland stood withing three fronts. Attacks from Nord, West and South. And this occured at September 1, 1939.

            • I think we might have to agree to disagree on this one Wolf.
              Certainly there were historic forces pulling the Germans into Poland. However, I think Hitler was different, he looked at things differently than the old school aristocrats in his Goverment and his Military.
              I think his Austrian heritage had something to do with this. He had more of an issue with the Czechs than the Poles.

    I wonder how Eisenhower felt about the Russians?

    Russian soldiers wantonly and viciously — also more or less with impunity, ie Russian officers and the Russian military establishment looked the other way — raped German and other women during the war.

    Anyone with some curiosity who visits Buchenwald learns that, after it was handed over to them, the Russians turned it into just another one of their NKVD gulags — here is what the German language Wikipedia says about ‘Speziallager Nr 2’:

    Mehr als 7000 Menschen kamen durch die unmenschlichen Lagerverhältnisse, insbesondere durch völlig unzureichende Ernährung und unbehandelte Folgeerkrankungen wie Dystrophie, Ruhr, Tuberkulose und Typhus ums Leben und wurden am Rande des Lagers in Massengräbern verscharrt.

    More than 7000 died there from starvation and disease due to the inhumane conditions — they are buried in mass graves near the edge of the (former) camp. These graves are marked and can be seen if you visit Gedenkstätte Buchenwald.

    • My great uncle was murdered in Buchenwald in 1950. He foolishly remained in Berlin in 1945 and his young son answered a knock on the door and let the NKVD in. He never saw his father again and lived with the guilt all his life. He never knew his fate, until I was able to tell him on his deathbed several years ago I saw his name in a book of names of those murdered at Buchenwald in the “haus am checkpoint charlie ” tourist museum (of all places)…RIF onkel Erich…

        I found a report in the British archives about the KLs the Soviets appropriated from the Germans:

        Buchenwald. An inmate of Buchenwald Camp during 1946 stated that persons who had been in the same camp under the Nazis complained that conditions were now worse. Some fat and meat had been issued by the Nazis, but under the Russians there was only bread and soup. It was estimated that the death rate was double that of the Nazi period. No correspondence was allowed.”

        • In Schlageter’s defense it was not uncommon for the NKVD to arrest Germans after the war for being particularly prosperous, a member of the nobility or the military, a member of the Nazi party (even a not particularly active one), Social Democrats, etc. The NKVD was not particularly picky about who and why they arrested.

      • Indeed Hans Nicolas EISENHAUER who arrived in America 1741 with his brother Peter still used the German spelling which Frederick later on Anglicized to ‘Eisenhower’.

  6. We should feel shame that such policies were even thought about let alone enacted against these soldiers. It was a stitch up from the start so as to justify our war efforts. The Germans had to be painted as evil and nasty people who sought blood and were a disgrace to mankind. The reality was that both side carried out atrocities, which happens in every war. I had a mate who fought the Argentinians in the Falklands conflict in 1982, he said he hoped no such investigations were ever carried out as there were some terrible things done by us.

    The sad thing is that this shame and guilt were heaped upon the German people and it has never stopped. They paid and continue to pay a very heavy price.

      • FURTHERGLORY. Germany is now the leading state of Europe and Cancellor Merkel seems as a new Fuehrer even while feeling uneasy in that role due to the weakness of other European leaders. As to the Jews, the relationship between Germany and Israel is very good and Germany offered shelter to Polish and Russian Jews who had to flee the anstisemitsm of the comunist regimes. So, Your statement about Jews destructing Germany is baseless.

          The point that I am trying to make is that the Jews are back in Germany, where they are now allowed to rule. The German people are bowing as low as they can to the Jews who now rule Germany.

            It’s best to search in German for that kind of info — latest info I could find on that is here — it says that in 2010 there were approx 105k Jews in Germany (source was Zentralrat der Juden, the main national Jewish organization) — it probably has not changed much — I think it is safe to say there are definitely less than 125k Jews in Germany today.

          • FURTHERGLORY. In the past German Jews had been forced to emigrate or deported. Few returned and there had been also Jewish refugees who remained in Germany. At any rate Jews in Germany are about 100.000 – onehundred thousand – and certainly do not rule. But … due to the deficit in population resulted from the two World Wars – both started and lost by Germany – no there are milions of Turk, Arab, etc immigrants: many of second generation, already citizens, not willing to follow German cultural models and customs. In such a condition how long can Jews still live in Germany? Your statement is not correct at all.

          I don’t know about ‘destruction’, but German officialdom pays what I would call extreme obeisance to Jewry — the most recent example being Merkel sanctimoniously and needlessly reiterating German responsibility for the ‘Holocaust’ — also regularly taking money from Germans, the vast, vast majority of whom had absolutely nothing to do with the ‘Holocaust’, in order to give it to Jews, the vast majority of whom were not victims of the ‘Holocaust’, all in the name of ‘reparations’ — aka extreme obeisance to Jewry.

          There has never been a Peace Treaty with Germany as compared to Japan, Spin Doctors worked around this point, the borders as they are now will probably remain as they were verbally confirmed by almost all reining Governments ever since Germany was expected to join the ‘good guys’ to assist in the Balance of Power to stoke up ‘Democracy’ with military power towards the East.
          The Poles would have to give up all those parts they gained after 1945. This will never happen in my life time although it is was once my home but I have no desire to see what it looks like now!
          History shows that there has never been any love lost up to this day between Germany and Poland and an undercurrent exists even now among the younger generation as there is still a boil on the Körper des Volkes (Body of the People) – just scratch the surface.

              • Of course, I think if I was a Pole I’d have some pretty hard feelings towards a lot of people. The British and French did not honor the terms of their treaty and Roosevelt fell over himself giving Stalin Polish territory. His only request was to keep this secret so it wouldn’t offend Polish voters in the United States.
                Basically the Poles were everyone’s sacrificial lamb. There were certain realities the Poles had to deal with. They thought that when the British and French declared war on Germany this meant the West was coming swiftly to their aid. What they didn’t know was that the British and French were not willing or able to come to their aid. As far as Stalin, he was determined to keep the Polish territory he acquired at such a huge cost. To eject him required force the Western Allies were not willing to exert, so, Poland lost her Eastern territories.
                Of course, the Poles acquired this territory by defeating the Soviet Union in 1921.
                I guess what comes around comes around.
