Should the Confederate flag be banned in America because “Black lives matter”?

The beginning [of] What is now called the Confederate flag was never the official banner of the Confederate States of America, whose secession prompted the Civil War.

It was actually a battle flag first used in 1861 by the Army of Northern Virginia, commanded by Gen. Robert E. Lee. Other military units followed suit, and eventually the flag — a diagonal blue cross inlaid with white stars against a red field — became the de facto battle flag of the Confederate army. Troops fought under a square flag. The rectangular version now familiar to us was employed by the Confederate Navy and known as the “naval jack.”

The cross [on the flag]

The blue cross, also known as a “saltire,” derives from the St. Andrews cross, the main element of Scotland’s national flag. According to legend, the first century Christian martyr St. Andrew considered himself unworthy to be executed in the same manner as Jesus and convinced his Roman executioners to use a different cross for his crucifixion. St. Andrew is the patron saint of Scotland, and the saltire in the Confederate battle flag reflects the Scottish ancestry of many [American] Southerners.

The stars [on the flag]

The flag’s 13 white stars signify the 11 Confederate states — South Carolina, Mississippi, Florida, Alabama, Georgia, Louisiana, Texas, Virginia, Arkansas, North Carolina and Tennessee — plus allies Kentucky and Missouri.

The memorials [ceremonies]

For several decades after the Civil War, the Confederate battle flag was seen mostly at memorial ceremonies for Southern soldiers. About 1920, though, the flag took on a more cultural meaning.

Students at the University of Alabama brandished the flag to celebrate a football victory over the University of Washington in 1926. Fans of other Southern schools — most notably the University of Mississippi — soon adopted the flag as an unofficial pennant. Historian John M. Coski reports the University of Florida adopted an orange-and-blue version of the Confederate banner as its official flag in 1952. New identity

Southerners serving overseas during World War II displayed the flag to project regional identity. Around the same time, the Ku Klux Klan adopted the flag as a symbol of its quest for white domination. Southern politicians, such as Strom Thurmond, a 1948 candidate for president from the Dixiecrat Party, also employed the flag as a totem of resistance to forced racial integration.

State flag

The official flags of Florida and some other Southern states include versions of the St. Andrew’s cross. Florida Gov. William Bloxham, a Confederate veteran, successfully urged the Legislature to add the saltire to an existing state flag in 1900, but it’s not clear if the new design was based on the Confederate flag.

The flag and the law

Florida statutes protect the Confederate flag and its replicas from desecration “by word or act.” The U.S. Supreme Court has rejected similar laws protecting the American flag from burning or mutilation as unconstitutional. Randall Marshall, legal director for the American Civil Liberties Union of Florida, said he knows of no attempted prosecutions under the law protecting the Confederate flag. Florida law also forbids the depiction of the flag for commercial gain, but that law is rarely if ever enforced.

It depends what you mean by “ban,” as this is a very inflammatory word, with the apparent meaning that one will not be able to display something on their own personal property, which does not appear to be the case. As you somewhat note, a display of any flag on one’s own person or property is still protected by freedom of speech. Therefore, no “ban” as such is threatened.

    What appears to be the issue is that there are still government and public buildings that display the Confederate flag. This is entirely different from a private citizen doing so, as a government/public building displaying it gives the impression of values (or threats) being made by that public institution or government office. If a “ban” as such would only apply to use by or on government/public buildings, the use of the word without this qualification is inflammatory and misleading.

    • There’s only one state in this union that flys the stars and bars. The state of Mississippi has it as part of the state flag. Get your facts straight before you open your piehole about that. You gonna cry next about the the flag of my state? Texas.       • State sponsored, sure, that’s my point. However, there are other states where it’s flown on some government buildings and NOT state-sponsored. Which, is, um, my point. (I believe a recent news story about a citizen climbing up to remove a confederate flag was not Mississippi, was it? NOT on part of an official state flag, genius.) So, are you suggesting that there is a “ban” being considered for private citizens on private property? If so, based on what, pray tell? Yet “I’m” the one opening my “pie hole” when you’re completely baselessly accusing me of having some problem with a state flag? How lovely that you have nothing better to do than make baseless accusations.

        • Where are you from? You certainly have no clue. South Carolina was the only other state. It’s not now though. State sponsored don’t have shit to do with the price of tea in China. It’s about honoring the dead,for fighting for what they believed in. That includes blacks that fought for the confederacy. Name one state,other than “Ol Miss”,that flys the stars and bars. If you’ve seen one at another state building than the one in question here,it’s probably because you saw those idiots from the invisible empire,having one of their stupid ass membership drives,in front of a government building. They always have the stars and bars at their piddly ass rallies. Guess what? This country allows them to do that .             • Also, by the way, since you mention “in front of government buildings,” it’s important to note that “time, place, and manner” restrictions ARE Constitutional, as long as they’re applied evenly to all people and groups operating or wishing to operate in a manner going against a “time, place, or manner” restriction. This means that as long as such restrictions are properly and evenly enforced, it DOES NOT MATTER who the group is. If you have any examples of time, place, or manner restrictions being improperly enforced, obviously this would need to be corrected.

              Again, I don’t even know what your point is. You keep agreeing with me that private citizens are allowed to display anything they want. So WHAT are you railing against in your absurdly angry comments??

You won’t see too many in Austin,because our wonderful state capital is full of liberal pukes. The great state of Mississippi still has the “stars and bars” on her state flag. Yes. Slavery lit the fuse for the civil war. People forget one thing though. The north was “modernizing”. We here in the south wished to stay “traditional”. The north wanted to push their way of life off on us. That’s BS. If we’re gonna split the proverbial “hairs” on this issue, then I want President Washington taken off the dollar bill. He was a slave owner. No gray area there. I want Thomas Jefferson off the two dollar bill. You got it! He owned slaves. My point to that shit is this. Blacks don’t like the stars and bars,because it represents a painful time in our nations history. What . Washington and Jefferson ain’t a painful reminder of that time? I don’t see the blacks complain when the carry around president Washington in their billfolds or purses. My wife’s late father was in the ranching business just like me. How the hell you think some slaves became land owners at the end of the war. Let’s not forget that at the end of the war,slave owners were paid for each slave they had to free.     The whole issue is brought upon us by the Jews who have a thing about white identity and any group of people that want to show their pride (other than black, brown, whatever ) who they consider whites racists. Hard to believe it has got to this point today but this is how the Jews work to stop any majority group (whites) from doing what they should be doing showing their Nationalist pride. It didn’t have shit to do with wether a private citizen could fly the flag or not. I put that out there to show you just how hot the topic of the rebel flag is.               • It is. People have also referred to the state that way in addition to the “Magnolia State “. Now if you go to MSU they’re nicknamed “Bulldogs”. Basically it’s not exclusive to the university. I have a couple friends. One in Yazoo city. The other one is in Bruce. When they speak of the state,they’ve both refered to her as “Ol Miss”. Kinda like you didn’t realize,Burlington Northern was in Alliance,Nebraska. You thought North Platte was the only location in Nebraska. Hell I thought Alliance was the only location for BNRR. The only thing I knew of North Platte was the Monfort Meat Packing house., Well they’re no longer Monfort. Con Agra bought out Monfort of Greeley and all her plant locations.

            • Please refer to your own comment. The “subject” is the Confederate flag. As I noted in my own comment ON THE SUBJECT, there is not even a possibility of a “ban” on private citizens displaying whatever they want, so the use of the word “ban” is irrelevant and ridiculous.

              Jim Rizoli, WHO I WAS RESPONDING TO, instead, decided to completely LEAVE the subject and blame any perceived oversensitivity by blacks on “the Jews.” Perhaps you should follow a comment’s thread rather than assuming that a reply TO A COMMENT is the one “dragging up other” topics, when it was the ORIGINAL COMMENT that did so and is being responded to. Good grief.
